If you are entering into this agreement on behalf of a physical gym or business entity, you represent that you have legal authority to bind that entity.
2. Description of Service
DumbWell provides a multi-tenant B2B Software-as-a-Service (SaaS) platform designed for physical gym management. Features include member records, role-aware staff workflows, QR-based attendance tracking, platform billing configuration, business analytics, and multi-branch consolidation.
3. Gym Tenant Accounts & Security
Gym operators are responsible for maintaining the confidentiality of account credentials reset via account.dumbwell.in and for all activities occurring under their tenant account. Operators must promptly notify DumbWell of any unauthorized account activity or security breach.
4. Platform Subscriptions & Billing
Platform usage is governed by DumbWell's configurable SaaS subscription architecture. Plans may be configured for Monthly, Quarterly, Half-Yearly, or Annual billing cycles. Each physical gym location operates as an independent tenant subscription unless explicit enterprise arrangements are agreed upon.
5. Acceptable Use Policy
Users agree not to misuse the DumbWell platform, attempt unauthorized access to isolated tenant boundaries, upload malicious code, or bypass system authentication controls.
6. Service Availability & Modifications
We strive for high system uptime and operational reliability. DumbWell reserves the right to perform scheduled maintenance, update platform features, or modify non-material software workflows to enhance system stability and performance.
7. Limitation of Liability
To the maximum extent permitted by applicable law, DumbWell and its operators shall not be liable for indirect, incidental, or consequential damages resulting from platform downtime, network disruption, or gym operational decisions.
